The Tennessee Supreme Court recently affirmed the court's decision to award a couple $13 million in punitive damages after filing a wrongful-death lawsuit against the former Daimler-Chrysler Auto Group. The lawsuit was brought to court after their 8-month-old was riding in the backseat of their 1998 Dodge Caravan when their vehicle was rear-ended, causing the front passenger seat to collapse and the passenger to strike him, fracturing his skull. This wrongful death lawsuit was settled with a 3-2 ruling after the court stated the automaker acted recklessly and the defective seat construction in the Dodge Caravan was to blame for the boy’s death.

Wow, what a tragic and unfortunate event. You would think that a large company like Chrysler would have tested their vehicles for impacts that can cause this sort of injury and fatality.
