Bike Week Results in One Fatailty

Bike Week usually means two things for local’s loud noise and increased traffic. Though important, we must also increase our alertness for these bikers. With the 2008 Pilgrimage over our roadways are quiet and reports indicate only one fatality had occurred.

Clarence Thomas Potter, 59, of Kenansville, was struck and killed as he rode his motorcycle. He died during early morning hours at New Hanover Regional Medical Center in Wilmington after being airlifted.

Police reports show the accident occurred at the intersection of 21st Avenueand Robert M. Grissom Parkway at 8 p.m.

“We don’t have many details on the wreck,” said Geri Romeo, records supervisor for the Myrtle Beach Police Department. “It is still under investigation.”

The two occupants of the Chevrolet Cavalier involved in the accident were not seriously injured, yet sustained heavy front-end damage to the vehicle as a result.

Charges have yet to be filed in the deadly wreck.
Myrtle Beach Imposes New Ordinances Before Fall Bike Rally

As we all know the months of May and October are times when thousands of bikers gather in Myrtle Beach for annual bike rallies. This year the fall rally will run from Wednesday, October 1st and continue through Sunday, October 5th. As a result of several newly imposed rules and regulations enacted by the city of Myrtle Beach, this rally will be slightly different than before. Though expected to be different, I must say as I made my way through town last night, I witnessed what I believe to be an influx in the number of bikers in town from mid-week last year.

Though there have been several limits placed on the bikers this rally which will more then likely continue on into the much larger Spring rally, bikers are urged to follow the basic more common sense rules through out the city, such as following the posted speed limits, the local noise ordinances which have been modified for this years event as well as the locally imposed helmet law.

Though the events are intended for fun and for all to enjoy the inevitable will occur. There will be DUI arrests, bikers will likely be injured or killed, and thousands upon thousands will be made in revenue from local officials issuing citations. Though things may be different this year than previous years, our law firm wishes the best for all bikers and hope everyone is safe and has the opportunity to enjoy the rally. To ensure your compliance with local rules and ordinances check out http://www.cityofmyrtlebeach.com/newordinances.html. This site will help you find a list of the local ordinaces already in place as well as a list of the recently created laws effective immediately here on the Grand Strand.
Originally posted at InjuryBoard by Will Parker

My Friend's Motorcycle Accident - An Insurance Company's Hospital Bedside Offer

A friend of mine has a brother who was recently in a motorcycle accident. To maintain anonymity, I will not refer to this gentleman's name. He is a 25 year old military officer. He has a pregnant wife and an infant child. He was taking a quarter of a mile trip across the street to a convenience store early one morning. Suddenly a 19 year old driver of a work van, who failed field sobriety testing (at 8 am), ran a red light and struck his motorcycle. My friend's brother suffered a broken fibia, broken tibia, a broken hip, six broken ribs, severe road rash and swelling to the brain.

At the scene, the 19 year old allegedly did not even offer to help my friend's brother and appeared more concerned about the van and the possibility he may be fired because of the accident. Following his first surgery, my friend's brother was called by the 19 year old's insurance company literally a dozen times within two days. They ultimately visited him at his hospital bedside (while he was on morphine) with paperwork. The offer for settlement - $3200! His projected medical bills - $150,000. His ability to walk, run, exercise - severely and permanently impaired. His future military career - compromised. His time in the hospital - 3 weeks. His time doing physical therapy and his out of work - 6 months. His scarring - permanent. His pain and suffering - ???... $3,200. Gimme a break.

I just want to demonstrate two points:

First, the importance of attaining legal advice. This gentleman, due to adequate insurance coverage and the factual scenario I have set forth, can likely recover over well $750,000. I honestly do not even believe that amount is enough considering his future prognosis.

Second - I believe this example demonstrates how evil and underhanded insurance companies can be.
Originally posted at InjuryBoard by Will Parker

Motorcycle "Accident" in Myrtle Beach Injures Two Bikers

I use the word "accident," but it was the intentional conduct (being drunk) of a Pennsylvania man that allegedly caused two innocent people to be injured during Harley Week. The point I am trying to make to bikers during Harley-Davidson Week in Myrtle Beach is to always remember you can not control the actions of another. And Mr. Sklar was certainly not the only intoxicated biker on the road last night.

Jonathan Sklar, 26, of Butler, PA was charged with felony driving under the influence with great bodily injury after a crash Monday night in Garden City Beach, according to an arrest warrant.

He was traveling on U.S. 17 Bypass and attempted to make a turn on to Atlantic Avenue and failied to yield the right of way to oncoming traffic. According to the warrant, his failure to yield caused a collision between his motorcycle and that of another.

The warrant further states tha Sklar was driving under the influence of alcohol at the time of the crash.

Sklar is currently being held at J. Reuben Long Detention Center awaiting a bond hearing, according to a jail official.

Two people were hurt in the accident. One person was taken to Georgetown Memorial Hospital for treatment and the other was flown to the Medical University of South Carolina in Charleston, South Carolina.
